The Law Association of Zambia (LAZ) is the statutory body responsible for regulating the legal profession in Zambia. It was established in 1973 by an Act of Parliament to uphold professional standards, maintain the rule of law, and ensure the independence of the judiciary. LAZ represents qualified legal practitioners across the country and plays a key role in legal advocacy, law reform, and providing legal aid to indigent individuals.

Objectives

The main objectives of LAZ include:

  • Promoting and upholding the rule of law in Zambia.
  • Providing professional development and guidance for legal practitioners.
  • Representing members in legal matters and safeguarding their professional rights.
  • Regulating ethical conduct within the legal profession.
  • Offering legal aid services to those who cannot afford legal representation.
  • Working with the government and non-governmental organisations (NGOs) on law reforms.

History

LAZ was founded in 1973, succeeding the Bar Association of Northern Rhodesia. It was part of Zambia's broader effort to establish national institutions following independence in 1964. Since its inception, LAZ has actively participated in shaping the legal landscape of the country, particularly through its involvement in significant national issues and constitutional advocacy.

Structure and Governance

LAZ is governed by a council headed by a President, who is elected by members. The council formulates policies and manages the association's affairs. Various committees, such as the Professional Conduct Committee and the Law Reform Committee, oversee specific tasks.

Activities

LAZ undertakes several activities in line with its objectives:

  • Legal Advocacy: LAZ engages in public interest litigation and advocates for governance, human rights, and constitutional issues.
  • Professional Training: It provides Continuing Legal Education (CLE) programmes to ensure that lawyers maintain up-to-date knowledge of legal developments.
  • Legal Aid: LAZ offers legal aid services to indigent persons to enhance access to justice.
  • Ethical Oversight: The association regulates the conduct of legal practitioners and takes disciplinary action where necessary.
  • Law Reform: LAZ collaborates with stakeholders to propose changes to outdated or ineffective laws.

Contributions

LAZ has been involved in several landmark legal cases and advocacy efforts. These include:

  • Advocating for judicial independence and constitutional reforms, particularly regarding Zambia's presidential term limits.
  • Defending human rights such as freedom of expression and press freedom.
  • Offering legal aid to underprivileged Zambians, thereby expanding access to justice.

Challenges

LAZ has faced challenges, particularly political pressure, as it balances its regulatory role with maintaining independence. Its positions on controversial national matters have drawn criticism at times, especially from government actors.

Notable Presidents

  • Linda Kasonde: The first female president, known for her strong advocacy on constitutional matters and human rights.
  • Eddie Mwitwa: Advocated for judicial independence and protection of civil liberties during a politically turbulent time.

Partnerships

LAZ collaborates with international legal bodies such as the International Bar Association (IBA) and the Southern African Development Community Lawyers' Association (SADC LA). These partnerships help promote the exchange of legal expertise and the upholding of international standards in the legal profession.
